Appellant Eric E. English appeals his conviction for first degree criminal sexual conduct with a minor and sentence of forty years' imprisonment, arguing the trial court erred by admitting the results of STD tests when the analysts who performed the testing did not testify to substantiate the test results and the results therefore constituted inadmissible hearsay evidence.

Courtroom I
 10:00 a.m. (Time Limits: 10-10-5)
2018-000988    The State, Respondent, v. Tammy Dianne Brown, Appellant.

Adam Sinclair Ruffin, of Columbia, for Appellant. Attorney General Alan McCrory Wilson and Jonathan Scott Matthews, both of Columbia, for Respondent.

Tammy D. Brown appeals her convictions for felony driving under the influence (DUI) resulting in death and felony DUI resulting in great bodily injury. Brown argues the trial court erred in (1) refusing to quash or dismiss the indictments because they did not allege the particular traffic violation the State sought to prove as an essential element of each offense; (2) admitting her blood sample taken at the hospital because she was not provided an independent sample and law enforcement did not offer her affirmative assistance; and (3) admitting testimony regarding her blood alcohol level from a sample obtained by law enforcement at the hospital when the collection of the sample was not recorded by video.

 10:40 a.m. (Time Limits: 10-10-5)
2018-000115    The State, Respondent, v. Montrelle Lamont Campbell, Appellant.

Lara Mary Caudy, of Columbia, for Appellant. Attorney General Alan McCrory Wilson, Deputy Attorney General Donald J. Zelenka, Senior Assistant Deputy Attorney General Melody Jane Brown, W. Jeffrey Young, and William Joseph Maye, all of Columbia, for Respondent.

Montrelle Lamont Campbell appeals his convictions of murder and attempted murder. He contends that because attempted murder is a specific intent crime, the trial court erred in charging the jury that malice may be inferred when a deadly weapon is used. Additionally, he maintains that because no evidence supported an accomplice liability charge, the trial court erred by instructing the jury on the hand of one is the hand of all theory of accomplice liability.

 11:20 a.m. (Time Limits: 20-20-10-10)
2018-001444    Encore Technology Group, LLC, Respondent/Appellant, v. Keone Trask and Clear Touch Interactive, Inc. f/k/a Clear Touch Interactive, LLC, Appellants/Respondents. AND Clear Touch Interactive, Inc. f/k/a Clear Touch Interactive, LLC, Appellant/Respondent, v. Encore Technology Group, LLC, Respondent/Appellant.

Joseph Owen Smith and Joshua Jennings Hudson, both of Smith Hudson Law, LLC, of Greenville, for Appellant-Respondents. Gregory Jacobs English and Rita Bolt Barker, both of Wyche Law Firm, of Greenville, for Respondent-Appellant.

Encore Technology brought and won various self-dealing claims against Keone Trask and Clear Touch Interactive. Trask and Clear Touch make several arguments as to why the circuit court's judgment should be reversed or modified, and Clear Touch argues the circuit court erred in dismissing its separate subsequent lawsuit against Encore. Encore cross-appeals the circuit court's failure to order restitution from Clear Touch.

 11:20 a.m.
2019-000530    Jami Powell and Encore Technology Group, LLC, Plaintiffs, Of which Encore Technology Group, LLC is the Appellant, v. Clear Touch Interactive, Inc. (a Nevada Corporation) f/k/a Clear Touch Interactive, LLC (a Nevada LLC); Keone Trask and Tamara Trask, Respondents.

Gregory Jacobs English and Rita Bolt Barker, both of Wyche Law Firm, of Greenville, for Appellant. Joseph Owen Smith and Joshua Jennings Hudson, both of Smith Hudson Law, LLC, of Greenville, for Respondents.

In the consolidated case, Encore Technology appeals circuit court orders staying receivership and dismissing Encore as a party in a dispute about Clear Touch's ownership once the judgments against Trask and Clear Touch in the primary appeal were paid into court.
