O R D E R



I find that many magistrates have assumed the powers of municipal judges without having been assigned those powers by the Chief Justice.

Pursuant to the powers vested in the Chief Justice by Section 4, Article V of the South Carolina Constitution,

IT IS ORDERED that after October 1, 1982 no magistrate shall serve as a municipal judge without having been assigned to that position by Order of the Chief Justice.

IT IS FURTHER ORDERED that the Office of Court Administration shall assist with the collection and transmittal of all papers relative to the assignments of magistrates to serve as municipal judges.

Failure to comply with this Order shall subject the party so failing to penalties as for contempt of court.
