RE:  Signing Off of Uniform Traffic Tickets

ORDER

The judges of the magistrates and municipal courts being a part of the Uniform Statewide Judicial System, and pursuant to the provisions of Article V, Section 4, South Carolina Constitution,

IT IS ORDERED that magistrates and municipal judges shall affix their signatures to the disposition portion of Uniform Traffic Tickets certifying the accuracy of the disposition of charges brought before them on those charging documents.  A person(s) designated by the judge may affix the judge’s signature to the Uniform Traffic Ticket, provided that the person is under direct supervision and control by the judge and not associated with the parties in the case, the signature is affixed in the judge’s presence, is exercised over only specific papers, and in the specific manner in which the judge has directly authorized for the particular case.  Provided, however, if the trial copy of the ticket is signed in the trial judge’s presence in the courtroom and while on the record, the remaining copies of the ticket may be conformed to the trial copy by the designated person(s) after court without the necessity of the trial judge’s presence.

This Order revokes the previous Order of the Chief Justice dated July 10, 1986, addressing this subject.  The provisions of this Order are effective immediately and remain in effect unless amended or revoked by subsequent Order of the Chief Justice.
