2021-000702   The State, Respondent, v. Jody Lynn Ward, Petitioner.

Tristan Michael Shaffer, of Chapin, for Petitioner. Attorney General Alan McCrory Wilson, Deputy Attorney General Donald J. Zelenka, Senior Assistant Deputy Attorney General Melody Jane Brown and Senior Assistant Attorney General J. Anthony Mabry, all of Columbia; and Solicitor Jimmy A. Richardson, of Conway, for Respondent.

Jody Lynn Ward appeals his double homicide conviction and concurrent sentences of life imprisonment. He does so on the basis that after-acquired evidence, unavailable at the time of trial, shows that a member of a prosecution witness's family served on the jury. The Court of Appeals rejected his arguments and we granted certiorari to review.

2021-000987   The State, Respondent, v. Jon Smart, Petitioner.

Appellate Defender Joanna Katherine Delany, of Columbia, for Petitioner. Attorney General Alan McCrory Wilson, Deputy Attorney General Donald J. Zelenka, Senior Assistant Deputy Attorney General Melody Jane Brown, Assistant Attorney General Tommy Evans, Jr. and W. Jeffrey Young all of Columbia; and Solicitor Ernest Adolphus Finney, III, of Sumter, for Respondent. Lindsey Sterling Vann and Hannah Lyon Freedman, both of Justice 360, of Columbia; and Melissa Anne Inzerillo, of Rock Hill, for the South Carolina Public Defender Association Amicus Curiae.

The Court granted a petition for a writ of certiorari to review the court of appeals' decision in State v. Smart, 433 S.C. 651, 861 S.E.2d 383 (Ct. App. 2021). The Court will determine whether the court of appeals erred in affirming Petitioner's sentence of life without parole for an offense committed as a juvenile.
