Re: CIVIL ACTION COVERSHEET AND FAMILY COURT COVERSHEET


 ADMINISTRATIVE ORDER


 

To improve statistical reporting, the Civil Action Coversheet and the Family Court Coversheet have been revised, as provided below, to include new and revised nature of action codes. 

Therefore, pursuant to the provisions of South Carolina Constitution Article V § 4,

IT IS ORDERED that SCCA 234 Civil Action Coversheet with a revision date of 6/2015 is approved in the Circuit Courts of the State of South Carolina and SCCA 467 Family Court Coversheet with a revision date of 6/2015 is approved in Family Courts of South Carolina. The Civil Action Coversheet is required with all initial pleadings filed in the Court of Common Pleas and the Family Court Coversheet is required with all initial pleadings filed in Family Court. The appropriate coversheet should be completed, in its entirety, by the plaintiff/petitioner or the attorney when initiating an action. The plaintiff is responsible for choosing the appropriate nature of action code on the coversheet. The coversheet shall remain as an attachment in order to document the nature of the action that is being filed and as proof of payment of the filing fee if applicable. The new forms are located at http://www.sccourts.org/forms.  These forms supersede and replace previous versions.  The revised coversheets are effective for cases filed after June 30, 2015.

Fraud/Bad Faith (150) Use when alleging intentional misrepresentation of fact.
Failure to Deliver/Warranty (160) Use when alleging failure to deliver goods, services, or warranty dispute.
Employment Discrimination (170) Use when alleging employment discrimination.
Employment (180) Use when any other type of employment dispute.
Assault/Battery (370) Use when alleging intentional act which caused apprehension or harm to a person.
Slander/Libel (380) Use when alleging a defamatory statement.
Pre-suit Discovery (670) Use for discovery prior to initiating a case.

Family Court Coversheet

Criminal Offense – Drug (315) Use when criminal juvenile delinquency case involves drugs.
Criminal Offense– Against a Person (316) Use when criminal juvenile delinquency case involves any crime against an individual person.
Criminal Offense – Property (317) Use when criminal juvenile delinquency case involves any crime to property.
Criminal Offense – Public Order/Against Society (318) Use when criminal juvenile delinquency case involves any crime against society at large.
Criminal Offense – Other (320) Use when any other criminal juvenile delinquency case.
Temporary Custody/ Nonparent (616) Use when one party is a non-parent in a custody/visitation determination.
