Re: Civil Action Coversheet SCCA/234

ORDER

Pursuant to the provisions of S.C. Const. Art. V § 4,

The Civil Action Coversheet, SCCA/234, bearing a revision date of 04/2008 is approved for use in the Circuit Courts of the State of South Carolina. The coversheet has been amended to have two nature of action codes for forfeiture cases arising out of drug seizures and DUI 4th convictions. For cases that are commenced with a consent order, the nature of action code will be 850, and for cases that are commenced with a petition, the nature of action code will be 840. Prior to this revision, the coversheet had one nature of action code (840) for all cases arising out of drug seizures and DUI 4th convictions.

The second revision to the Civil Action Coversheet moves the Sexual Predator nature of action from the Inmate Petitions section to the Special/Complex/Other section. This revision has been made to better reflect the purpose of a sexual predator civil commitment. The nature of action code for Sexual Predator (510) will remain the same.

The Civil Action Coversheet is required with all initial pleadings filed in the Court of Common Pleas. This coversheet should be completed, in its entirety, by the attorney filing the action and served on the defendant with the Summons and Complaint. This coversheet shall remain as an attachment in order to document the nature of the action that is being filed and as proof of payment of the filing fee. Form SCCA/234 (4/2008) supersedes and replaces the coversheet bearing a revision date of 8/2006.
