Re:  Revision of Motion and Affidavit to Proceed In Forma Pauperis


ORDER


Pursuant to the provisions of S.C. Const. Art. V § 4,

IT IS ORDERED that Form SCCA 405F, Motion and Affidavit to Proceed In Forma Pauperis, bearing a revision date of (5/08), is approved for use in the Family Courts of South Carolina.  The revised form allows the family court to establish a due date by which the filing fee and other associated fees are to be paid to prevent automatic dismissal of the case where the motion to proceed is denied without further order of the court.  Clerks of Court shall assign a case number before presenting the judge with the motion for consideration.  In addition to promoting statewide uniformity of processing these motions, the revision is intended to remove cases with denied motions and where no payment has been received from the pending docket sooner than the 365 Family Court Benchmark currently allows.  The revision will help clerks manage the family court dockets more efficiently.  The revised form supersedes all previous versions of this form.
