The Honorable Mark Sanford, in his official capacity as the Governor of the State of South Carolina, and The Honorable Jim Rex, in his official capacity as the State Superintendent of Education of South Carolina, Respondents.


ORDER


After this Court accepted the first action (Edwards Action) in our original jurisdiction, Governor Sanford was permitted to intervene in the action and was joined as a party. The Governor then removed the action to federal court.

The second action (SCASA Action) was also filed in this Court in our original jurisdiction. The Governor also removed this action to federal court.

The Honorable Joseph F. Anderson, Jr., United States District Court Judge for the District of South Carolina, has now remanded both the Edwards Action and the SCASA Action to this Court.

We accept the SCASA Action in our original jurisdiction. Because of the urgency of these matters, the
Governor shall serve and file an answer and a brief, if desired, in both the Edwards Action and the SCASA Action by 10:00 a.m. on Tuesday, June 2, 2009. Any replies to the Answer and brief shall be served and filed by 2:00 p.m. on Tuesday, June 2, 2009. The copies filed with this Court must be actually received by the Court and hand served on the opposing parties by the times designated above.

Oral argument shall be held in these matters at 10:00 a.m. on Wednesday, June 3, 2009, with the SCASA Action being argued immediately following the Edwards Action argument. The time allotted for argument in each case is as follows:
