RE: Amendment to SCCA 223B, Order for the Destruction of Arrest Records in the Summary Courts


ORDER


I find that Act No. 276 of 2014 amended S.C. Code §§17-1-40 and 17-22-950 regarding expungements in summary courts, so as to necessitate the amendment of SCCA 223B, Order for the Destruction of Arrest Records in the Summary Courts.

Therefore, pursuant to the provisions of S.C. Constitution Article V, §4,

IT IS ORDERED that SCCA 223B, Order for the Destruction of Arrest Records, bearing a revision date of 8/2014, is approved for use in magistrate and municipal courts. This form shall be used to the exclusion of all others when records are sought to be expunged pursuant to SC. Code §§17-1-40 and 17-22-950, for criminal charges which are dismissed, nol prossed or the defendant is found not guilty. This form shall be available on the SC judicial Department website at www.sccourts.org and included in the Statewide Case Management System. This Order supersedes the previous order of the Chief Justice dated July 20, 2009, regarding amendment to this form, is effective immediately, and remains in effect unless amended or revoked by further order of the Chief Justice.
