28005 - State v. Harrison

In this appeal, Appellant challenges the authority of Solicitor Pascoe. The Court affirms the perjury conviction and eighteen-month sentence, for the perjury charge arose during the course of the authorized State Grand Jury investigation. Because Solicitor Pascoe lacked authority to independently prosecute Appellant, the misconduct in office charges are vacated. The matter is remanded to the trial court, and the Attorney General shall declare whether he or a designee shall pursue corruption charges against Appellant.
