Chief Justice Toal has approved SCCA/221(3/05), the Order for Competency to Stand Trial, and SCCA/222(3/05), the Order for Criminal Responsibility, for use in the Court of General Sessions.  Both forms are to be used by the circuit court judges for the purpose of ordering mental evaluations of criminal defendants.  The new orders bifurcate the previous order for criminal responsibility and order for competency, both formerly under SCCA/221.  The use of SCCA/221(3/05) and SCCA/222(3/05) will be mandatory, effective April 23, 2005.
