IT IS ORDERED that the judges of the magisterial courts listed below be designated as Chief Judge or Associate Chief Judge for Administrative Purposes of the Summary Courts in the counties in which they hold office.


By Order dated December 1, 2005, the Supreme Court amended Comment [4] to Rule 3.8 of the Rules of Professional Conduct, Rule 407, SCACR, by deleting the final sentence of the comment which stated a prosecutor is required to obtain court approval for the issuance of lawyer subpoenas in grand jury and other criminal proceedings after an opportunity for an adversarial hearing is afforded. 


Chief Justice Jean Toal met with Beaufort and Jasper County Officials on November 22nd to discuss the implementation of the Case Management System in Beaufort and Jasper counties. 


SCJD Recognition

SCJD was recently recognized for partnering with DHEC in reporting recycling achievements for Fiscal Year 2005.


Chief Justice Toal spoke on behalf of a delegation supporting the construction of a new Judicial Center for Georgetown County.


The National College of Probate Judges has selected the Greenville County Probate Court's website as one of the Top Ten Probate Court Websites in the country.

Amendment to Rule 402

The Court has amended Rule 402(d)(1)(i), SCACR.

By order dated June 20, 2005, we substantially amended the Rules of Professional Conduct, Rule 407, SCACR, to incorporate many of the changes made by the ABA to the Model Rules of Professional Conduct as part of its Ethics 2000 initiative, as well as other changes. These amendments become effective October 1, 2005.

In recognition of the devastation and disruption of daily life suffered by the residents of Louisiana, Mississippi and Alabama as a result of Hurricane Katrina, the Supreme Court has issued an order relaxing rules for admission pro hac vice and for admission to the practice of law in the State of South Carolina for lawyers admitted to practice in those states, and who have been displaced due to Hurricane Katrina.


The Court Security Task Force, under the leadership of Chief Justice Jean Toal and Chief Robert Stewart of SLED, has recommended establishment of county court security committees to address courthouse security concerns.

Judicial Elections

Judicial elections were held May 25, 2005.


Greenville attorney Daniel B. White was installed as the 2005-2006 president of the South Carolina Bar.


To celebrate Law Week and the importance of women to the practice of law in South Carolina, the South Carolina Women Lawyers Association invited all women lawyers and judges to gather on the steps of courthouses in Columbia, Charleston, Spartanburg and Myrtle Beach on Monday, May 2.


Rule 227, SCACR, relating to the review of orders in post-conviction relief actions, has been amended. These amendments are effective May 1, 2005.

Rules 5(a) and 30(a) of the South Carolina Rules of Civil Procedure have been amended.


Circuit Court Judge James E. Lockemy was presented the Order of the Palmetto on April 25, 2005 by Representative Jackie Hayes.

The Supreme Court has issued an order administratively suspending lawyers under Rule 419, SCACR.


Chief Justice Toal has approved SCCA/221(3/05), the Order for Competency to Stand Trial, and SCCA/222(3/05), the Order for Criminal Responsibility, for use in the Court of General Sessions.


IT IS ORDERED that Judge Robert B. Hall be designated as Chief Judge for Administrative Purposes of the Summary Courts for Spartanburg County and that Judge David Turner be designated as Associate Chief Judge for Administrative Purposes for Spartanburg County and their authority shall include, but not be limited to, the administrative purposes and acts set forth in my Order dated December 16, 2004, designating Chief Judges statewide.
