Courtroom I
 10:00 a.m. (Time Limits: 10-10-5)
2016-000963    Three Blind Mice, LLC, d/b/a The Blind Horse Saloon, Respondent, v. Colony Insurance Company, Appellant.

Eric K. Englebardt of Wilson & Englebardt, LLC, of Greenville, for Appellant. David Grant Harris, II, of Greensboro, North Carolina, for Appellant. David L. Brown, of Greensboro, North Carolina, for Appellant. William W. Wilkins and Andrew A. Mathias, both of Nexsen Pruet, LLC of Greenville, for Respondent. Daniel Ray McCoy, Robert Curt Calamari, and Nicholas Andrew Charles. all of Nelson Mullins Riley & Scarborough, LLP, for amicus curiae.

Colony Insurance Company (Colony) appeals a circuit court order granting summary judgment to its insured, Three Blind Mice, LLC d/b/a The Blind Horse Saloon (the Blind Horse) on causes of action for breach of contract and bad faith denial of coverage. On appeal, Colony argues the circuit court erred in granting summary judgment (1) on the breach of contract action because the plain language of the contract excluded coverage, and (2) on the bad faith action because even if the contract provided coverage, Colony reasonably interpreted it to exclude coverage.

 10:40 a.m. (Time Limits: 10-10-5)
2016-001214    Quicken Loans, Inc., Appellant, v. Wayne D. Wilson; Calvin O. Wilson, III; any other Heirs-in-Law or devisees of Ezekial (Ellen) T. Wilson, deceased, their heirs, personal representatives, administrators, successors and assigns, and all other persons entitled to claim through them; all unknown persons with any right, title or interests in the real estate described herein; also any persons who may be in a class designated as John Doe; any unknown minors or persons under a disability being a class designated as Richard Roe; Park Sterling Bank, Respondents.

Dibble of Dibble Law Offices, of Columbia, for Respondents. Steven W. Hamm and Jo Anne Wessinger Hill, both of Richardson Plowden & Robinson, PA, of Columbia, for Respondents. Daniel Webster Williams of Bedingfield & Williams, of Barnwell, for Respondents C. Bradley Hutto, of Williams & Williams, of Orangeburg, for Respondents. Carolyn Grube Lybarker and Kelly Hunter Rainsford of SC Department of Consumer Affairs, for amicus curiae.

In this foreclosure action, Quicken Loans, Inc. (Quicken) appeals the special referee's order granting Respondent's motion for partial summary judgment, arguing the special referee erred in (1) holding Quicken violated the Attorney Preference Statute (the Act); (2) finding Quicken's violations were unconscionable and provided a remedy under the Act; (3) failing to find Respondent's counterclaim was time-barred by the statute of limitations; (4) denying Quicken's jury trial demand and motion to amend the pleadings; and (5) relying on confidential information subject to a protective order in an unrelated case.

 11:20 a.m. (Time Limits: 10-10-5)
2016-000958    Wells Fargo Bank, N.A., Plaintiff, v. William R. Hudspeth, Marcia E. Hudspeth; TD Bank, N.A. s/b/m to Carolina First Bank; The Lender Group, Inc.; Business Carolina, Inc.; South Carolina Department of Revenue; Carapace, LLC; Wurth Wood Group, Inc.; The Estate of Harry William Boyd, by Joan L. Boyd, Personal Representative; Adecco USA, Inc., Defendants, Of Whom TD Bank, N.A. successor by merger to Carolina First Bank is the Appellant, and Of Whom The Lender Group, Inc. is the Respondent.

Samuel Lindsay Carrington and James Martin Page, both of Bell Carrington & Price, LLC, of Columbia, for Appellant. Brett L. Messinger, of Cherry Hill, New Jersey, for Appellant. Christopher Lee Boguski and Robert B. Lewis, both of Rogers Lewis Jackson Mann & Quinn, LLC, of Columbia, for Respondent.

In this civil matter, TD Bank, N.A., appeals the master-in-equity's order allocating the surplus proceeds from a foreclosure sale of a senior mortgage to The Lender Group, Inc. TD Bank argues the master erred when it allocated the surplus funds from the foreclosure sale to Lender Group, a third-priority judgment lienholder, before allocating the surplus funds to TD Bank, the second-priority lienholder and the purchaser at the foreclosure sale, because the priority of a lien attaches to the surplus funds before the foreclosure sale regardless of the purchaser's identity.

 12:00 p.m. (Time Limits: 10-10-5)
2016-000419    Rosemary Connelly, Respondent, v. Winsor Custom Homes, LLC, Appellant.

Stephen Lynwood Brown and Russell Grainger Hines, both of Young Clement Rivers, of Charleston, for Appellant. John A. Massalon and Christy Ford Allen, both of Wills Massalon & Allen, LLC, of Charleston, for Respondent.

This case arises out of injuries sustained by Rosemary Connelly while running on a sidewalk in front of a home under construction on Daniel Island. Winsor Custom Homes (Winsor) was the general contractor for the home. Connelly sued Winsor for negligence and a jury awarded Connelly $500,000. The jury found Connelly was 35% comparatively negligent and the trial judge reduced the award accordingly. Winsor appeals.

2016-000868    The State, Respondent, v. Marshell Hill, Appellant.

Appellate Defender Kathrine Haggard Hudgins, of Columbia, for Appellant. Attorney General Alan McCrory Wilson and Senior Assistant Attorney General David A. Spencer, both of Columbia, for Respondent. Solicitor William Walter Wilkins, III, of Greenville, for Respondent.

Marshell Hill appeals his conviction of voluntary manslaughter, for which the trial court sentenced him to twenty-two years imprisonment. On appeal, Hill argues the trial court erred in (1) finding he was not in custody when he made an inculpatory statement to police, and (2) admitting a video recorded statement that he made during a custodial interrogation.

 2:40 p.m. (Time Limits: 10-10-5)
2016-001642    Dish DBS Corporation, f/k/a EchoStar, DBS Corp., and Affiliates, Appellant, v. South Carolina Department of Revenue, Respondent.

Burnet Rhett Maybank, III, and James Peter Rourke, both of Nexsen Pruet, LLC, of Columbia, for Appellant. William J. Condon, Jr., Nicole Martin Wooten, and Jason Phillip Luther, all of Columbia, for Respondent. Steve A. Matthews of Haynsworth Sinkler Boyd, PA, of Columbia, for Amicus Curiae South Carolina Chamber of Commerce. Charles T. Speth, II, of Ogletree Deakins Nash Smoak & Stewart, PC, of Columbia, for Amicus Curiae South Carolina Chamber of Commerce.

In this appeal from the Administrative Law Court (ALC), Dish DBS Corporation (Dish DBS) argues the ALC erred in (1) not excluding the expert testimony of Dr. Glenn Harrison, (2) finding South Carolina is not a pro rata cost of performance state and adopting a market share approach for apportioning multi-state income for corporate tax purposes, (3) disregarding Dish DBS's income producing activities, and (4) upholding the imposition of substantial understatement penalties on Dish DBS.
