State of South Carolina, Petitioner, v. Rorey Jamar Johnson, Respondent
Respondent was convicted in circuit court in Greenville County of murder.� However, the trial judge granted respondent a new trial based on a statement by a witness that she had not passed a polygraph (lie detector) test.� The State of South Carolina appealed, arguing the trial judge abused his discretion in granting a new trial based on the brief comment by the witness.� The Court of Appeals affirmed the trial judge�s decision.� The State now asks the South Carolina Supreme Court to review the Court of Appeals� decision.
