ADMINISTRATIVE ORDER
To improve statistical reporting and to accurately apply family court civil filing fees, the Family Court Coversheet has been revised to include an additional nature of action code, Registration of Foreign Divorce Decree with custody or support (191). This code should be used to file a foreign divorce decree that contains a duty of support as defined in S.C. Code of Laws Ann. 63-17-2910 et seq. (Uniform Interstate Family Support Act (UIFSA)) or that includes a child custody determination as defined in S.C. Code of Laws Ann. 63-15-302 et seq. (Uniform Child Custody Jurisdiction Enforcement Act (UCCJEA)). The current nature of action code, Registration of Foreign Divorce Decree (190), should be used to register a foreign divorce decree that does not contain support or child custody provisions. The plaintiff is responsible for choosing the appropriate nature of action code on the coversheet. Since the family court civil filing fee is not required for the registration of foreign orders that contain support or child custody provisions, the additional nature of action code is necessary.
Therefore, pursuant to the provisions of South Carolina Constitution Article V 4, IT IS ORDERED that the revised SCCA 467 - Family Court Coversheet with a revision date of (6/2010) is approved for use in Family Courts of South Carolina. The new form is located at http://www.sccourts.org/forms. All previous versions of this form are obsolete.
