The Court granted certiorari to review the decision of the Court of Appeals in Stephens v. CSX Transp., Inc., 400 S.C. 503, 735 S.E.2d 505 (Ct. App. 2012), which affirmed a defense verdict in a negligence action involving a collision between a train and an automobile at a railroad crossing.
