Re: Conditional Discharge Form and General Sessions Sentence Sheet Form
ADMINISTRATIVE ORDER
I find that in accordance with the recent adoption of a uniform statewide procedure for processing Conditional Discharge actions in the Court of General Sessions pursuant to Act 273 of 2010, a Conditional Discharge Form (SCCA/218) has been created. This form has been developed to record that a defendant has entered a conditional discharge program and that the defendant is required to pay a $350.00 conditional discharge fee prior to the successful completion of the program. Further, the General Sessions Sentence Sheet Form (SCCA/217) has been revised since it will no longer be completed when a person enters a conditional discharge program. The Sentence Sheet Form has been revised to remove the $350.00 Conditional Discharge fee and Conditional Discharge checkbox.
THEREFORE, pursuant to the provisions of S.C. Const. Art. V § 4,
IT IS ORDERED THAT the Conditional Discharge Form (SCCA/218), bearing a date of 03/2011, is approved for use in the Circuit Courts of South Carolina, and the General Sessions Sentence Sheet Form (SCCA/217) bearing a revision date of 03/2011, is approved for use in the Circuit Courts of South Carolina and supersedes SCCA/217, bearing a revision date of 06/2010. These forms shall be available on the South Carolina Judicial Department website at www.sccourts.org under the ‘Forms’ link.
